1. About these terms
These terms are an agreement between you and FloorStage ("we", "us"), a company registered in Wyoming, United States; they cover floorstage.com and any app we publish. "You" means the person or business that holds the account.
You accept these terms when you create an account or use FloorStage. If you use FloorStage for a business, you confirm you are allowed to accept them for that business. Our Privacy Policy is part of this agreement.
2. Your account
- You must be at least 18.
- One account per person or business. Your login is yours alone. Keep your password private. You are responsible for everything done through your account until you tell us it has been compromised.
- You choose your currency (Australian dollars or US dollars) when you register. It cannot be changed afterwards.
- Keep your name, email address and billing details correct. We send every notice to the email address on your account.
3. What we provide
FloorStage provides digital services for real-estate marketing:
- Floor plans and site plans, drawn by our team from what you send us.
- Virtual staging — done by our team from your photos as an order, or instantly with AI, or hands-on in our 3D staging editor; and 3D furniture models made from your photos for that editor.
- AI photo editing — HDR editing, twilight conversion, relighting, furniture removal, edits from your instructions and design transfer.
- The floor plan editor — software for drawing and editing floor plans yourself.
- Delivery pages for handing results to your clients; on a paid plan, with the option to charge them before they download.
Everything we provide is for marketing a property. Plans, staged images, edited photos, 3D models and anything drawn in the editor are marketing illustrations. They are not architectural drawings, surveys or measured documents, and must not be relied on for building, renovation, valuation, lending, insurance, leasing or legal purposes (section 5).
Every result depends on what you send us and what you ask for. We may add, change or withdraw a service at any time; the price and availability of each service is shown in the app before you commit.
4. No result is guaranteed — this applies to everything we do
Every result we produce — an edited photo, a staged image, a render, a 3D model, a floor plan, a site plan — is made from what you send us and what you ask for. Photos, scans, sketches, plans and instructions that are inaccurate, incomplete or unclear produce results that are too. We do not guarantee that any result is accurate, complete, to a particular standard, or what you expected, and we do not check any result against the real property. Checking a result, and deciding whether to use it, is yours to do.
We answer for faults that are ours: a technical failure that produces no result, or work by our team that does not follow what you sent and asked for. Those we put right as sections 5 and 9 say — tokens returned to your balance, or the work corrected. We do not answer for a result that is wrong because of what was sent, what was asked for, how an AI system interpreted it, or how the result was used afterwards.
AI is not exact. Every AI result is generated from your photo, your instructions, and the tool, model and settings you chose. The same request can give a different result each time. A result can be wrong, incomplete, different from what you asked for, or simply not what you had in mind.
We guarantee no result. We do not promise that any AI result is accurate, of a particular quality or style, follows your instructions, matches an example, or suits your listing or any other purpose.
Getting the result you want is your job. You choose the tool, the model and the settings, you write the instructions, and you check every result. If a result is not right, you try again — with different instructions, a different model, a different tool or a different photo. Every attempt costs the tokens shown before you start, whether or not you like the result.
A result you do not like is not a fault. A result that does not follow your instructions, does not look right, or is not what you expected is not a failure of the service, and the tokens spent on it are not returned. The only failure that returns tokens is a technical one, where the service produces no result at all; those tokens go back to your balance (section 9).
Check before you use. You must check every result before you publish it, send it to a client or use it in any listing. We are not responsible for what a result shows once you have used it.
Do not mislead. You must not use FloorStage to hide damage, defects, structural features or anything else a buyer or tenant would reasonably want to know, or to give a false impression of a property. Staging, lighting, sky and lawn improvements and removing your own equipment from a picture are fine.
Disclose edits where required. Many listing sites, agent rules and consumer laws require you to say when a photo is virtually staged or digitally altered. Those disclosures are your responsibility. FloorStage can label staged and edited images on delivery pages; keeping or removing that label, and any other disclosure, is your decision.
If you work for someone else. If you produce results for an agent, an owner or a developer, you are responsible for how they use those results and for passing on the duties in this section.
Follow the law. You must not use FloorStage in a way that breaks fair-housing, anti-discrimination or advertising laws where you operate.
5. Work done by our team — floor plans, site plans and ordered virtual staging
- Our team works from what you send: the sketch, scan, link or plan for a floor plan or site plan; the photos and the style you pick for a staging order. A scan that missed a wall, a sketch with a wrong measurement, a photo that hides part of the room or an unclear brief gives a result with the same fault. We do not guarantee that a plan is accurate or matches the property, or that a staged image is what you had in mind (section 4).
- Plans are illustrations for marketing. Unless the plan says otherwise, it is not to scale, measurements are approximate, and it must not be used for construction, surveying, valuation, insurance, lease, certification, legal or planning purposes. Any measurement that matters must be verified independently. If a plan carries a printed disclaimer, it must stay on it.
- Every order includes one round of revisions. That round is the remedy for anything our team did differently from what you sent and asked for: tell us, and we correct it at no charge. A change of mind, a new style, a fault in what you sent, or a detail you did not give us when you ordered is a further revision round at the price shown in the app; a different property, floor, photo or source is a new order.
- Where an order includes a preview, we start the final work after you approve the preview. Approving the preview uses the included revision round.
- An order reflects what you had sent when we did the work. A new or corrected source after that is a further revision round or a new order.
- Delivery times are targets, not guarantees. The time shown when you order is our aim, not a promise; a late delivery is not a reason for a refund.
6. Who owns what
Your uploads are yours. You keep all rights in the photos, scans, sketches, plans, templates and branding you upload, including inside an edited or staged version of your photo.
What we create is ours, and yours to use. Our plan styles, staging styles, furniture catalogue and software are ours, and so is what we create for you: the floor plans and site plans we draw, the staging compositions and renders, and the 3D models made from your photos, which we may add to our catalogue. You get a permanent, commercial licence to use every result to market the property it was made for, and in your business, at no further cost.
The permission you give us. To provide the service you allow us to store, copy, resize, process, send and display what you upload, including passing it to our team and the AI systems that produce your results. This permission lasts while the content is on FloorStage and for a short time afterwards while it clears from our backups.
Showing your work as examples. The "Showcase my results" setting is on by default. While it is on, you allow us to use your uploads and the results made from them as anonymised before-and-after examples in our marketing — on our website, in our newsletter, in advertising and on social media — without the property address, your name or your client's details. Switch it off at any time and, from that moment, we won't publish any new examples from your account. Examples published before then may stay where they are, even if you later delete the photos or close your account.
No AI training. We do not use what you upload to train AI systems, and we only pass it to AI companies to produce the result you asked for.
Your promises. You confirm that you have the right to upload your content and to have it edited, and that it is not illegal, does not infringe anyone's rights, and does not show a person in a way that breaches their privacy. If someone claims otherwise, the claim and its costs are yours, and we may remove the content.
7. Delivery pages, your clients and plans
- A delivery page is a public link. Anyone with the link can view and download what you have chosen to include until you switch the link off. What is shared, and with whom, is your decision.
- Your clients' details on a delivery page are handled for you. Telling your clients what you share with them is your responsibility.
- On a paid plan you can charge your client to unlock a page. Your client then pays you, through your own Stripe account. We are not involved in that sale and do not hold that money. Refunds, disputes, receipts and taxes for that sale are between you and your client.
- Branded delivery addresses are available on a paid plan. If that plan ends, a branded link takes visitors to the same page at its floorstage.com address.
- Plans. What each plan includes and costs is shown on the plans page. A plan starts as soon as your payment goes through, and that day becomes your monthly renewal date. A paid plan renews automatically every month and is charged to your card until you cancel. You can cancel at any time in Settings → Billing; the plan stays active until the end of the month you have paid for, and that month is not refunded.
- Your plan's price. Your monthly price stays the same for as long as you stay on the same plan, including a launch price. Moving to a higher plan starts at once: you pay the difference for the rest of the current month, then the new plan's price. Moving to a lower plan takes effect at the end of the month you have paid for. If your plan ends and you join again later, the price at that time applies.
- If a payment fails. We try your card again over the next 7 days. Until it is paid, your plan's AI discount and new uploads are paused. If it is still unpaid after 7 days, your account moves to the Free plan. Nothing is deleted (section 10).
8. Prices and payment
- Prices are in US dollars or Australian dollars (your account's currency) and are shown in the app before you commit. We may change prices at any time; a change never affects an order you have already placed, tokens you have already bought, or the price of the plan you are on (section 7). We do not add GST, VAT or sales tax to our prices; any tax that applies to your purchase where you live is yours to handle.
- Credit pays for work done by our team (section 5). It is a prepayment with no cash value: it earns no interest, cannot be withdrawn, moved to another account, or exchanged for another currency or for tokens.
- Tokens pay for AI services. Each AI result costs the number of tokens shown before you start, and the tokens are spent the moment you start it. Tokens you buy do not expire. Tokens we give you for free expire on the date shown. Tokens have no cash value and cannot be transferred or exchanged for credit.
- Card payments and plan billing are handled by Stripe.
9. Refunds
Nothing that has been generated or delivered is refunded. A refund happens only when something is wrong on our side:
- A technical failure that produces no result: the tokens are returned to your balance.
- A service we stop offering, or an order we cannot complete, that you have already paid for: what you paid goes back to your balance.
- Where the law gives you a refund right for a major failure on our side, we honour it.
We do not refund:
- a result you do not like or that is not what you asked for (section 4);
- tokens you have not spent, or credit you have not used — they stay in your balance for you to use until the account closes (sections 10 and 13);
- an order once you have placed it, or a change of mind;
- delivered work — a plan, a site plan or a staged image. Anything our team did differently from what you sent and asked for is corrected under the included revision round (section 5); that is the remedy. Work that faithfully follows a faulty scan, sketch, photo or brief is not our error.
Work on an order can start the moment you place it, so a placed order cannot be cancelled. Until you place it, nothing is charged.
Chargebacks. If you think a charge is wrong, write to us first. A chargeback on tokens, credit or work we delivered may lead us to suspend the account until it is resolved.
10. Storage and inactive accounts
- Every account includes 5 GB of storage for photos and AI results; a paid plan includes more, as shown on the plans page. When you reach your limit, uploads pause until you free space or upgrade.
- Inactive accounts. If you do not sign in for 12 months, we may close your account. We warn you by email first; signing in keeps it open. A closed inactive account loses its content and its balances, and nothing is refunded (section 9).
11. Acceptable use
You must not:
- upload content you have no right to use, or that is illegal, defamatory, hateful, sexual, violent or otherwise objectionable;
- use FloorStage to deceive anyone about a property (section 4);
- share your login, sell access to your account, or copy or resell the service;
- copy, decompile or reverse engineer any part of FloorStage, including the floor plan editor;
- resell, rent out or offer the floor plan editor or any other tool to others as your own service;
- interfere with the service, its security or its limits, or run automated tools against it;
- use results to build a competing AI system or service;
- use FloorStage to send unsolicited messages or to break any law.
We may remove content and suspend or close accounts that break these rules.
12. Availability, changes and things outside our control
We do not guarantee that FloorStage is available at all times. We may take it down for maintenance, and we may change, limit or withdraw a service, tool or model at any time; your tokens and credit are unaffected. If we withdraw a service entirely, we give you at least 30 days' notice to download your content.
We are not responsible for a failure or delay caused by something outside our reasonable control: an outage or change at the AI companies, hosting, storage, network or payment providers we rely on, an internet failure, or events such as fire, flood, strikes or government action. A result that fails for such a reason counts as a technical failure (section 9).
13. Ending this agreement
By you. You can close your account at any time. Download what you want to keep first: once the account is closed, your content is gone. Records of payments are kept for as long as the law requires. Unused credit and unspent tokens are not refunded (section 9) — use them before you close the account.
By us. We may suspend or close your account if you break these terms, do not pay, put the service or other users at risk, or if the law requires it. Where it is fair, we warn you first. We may also close your account or the whole service for any other reason on 30 days' notice; in that case unused paid credit and unspent purchased tokens are returned to you.
Sections 4, 5, 6, 14, 15, 16 and 17 continue to apply after the agreement ends.
14. Warranties and your legal rights
We provide FloorStage with reasonable care and skill. Beyond that, and beyond what the law does not let us exclude, the service and every result are provided as they are: we do not promise that they are free of errors, that a result is accurate or suitable for a particular purpose, or that the service will meet your requirements.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law and similar consumer laws elsewhere. Where such a law allows us to limit our liability for a breach of a guarantee, our liability is limited, at our choice, to supplying the service again or paying the cost of having it supplied again.
15. Our liability
To the fullest extent the law allows, we are not liable for any loss or damage of any kind arising from FloorStage, any result, or how you or anyone else uses them.
Nothing in this section limits liability that the law does not allow us to limit.
16. Claims caused by you
If someone brings a claim against us because of content you uploaded, results you published, a disclosure you did not make, a sale you made through a delivery page, or your breach of these terms, you will cover our reasonable costs and any amount we have to pay, provided we tell you about the claim promptly and let you take part in the defence.
17. Which law applies
These terms are governed by the laws of the State of Wyoming, United States, and its courts have exclusive jurisdiction, except that consumers keep any right to bring a claim where they live. Before starting a claim, both of us agree to write to the other and try to resolve the matter within 30 days.
18. Changes to these terms
We may update these terms. For a change that reduces your rights or adds obligations we email you and show a notice in the app at least 14 days before it takes effect; using FloorStage after that date means you accept the change. Other changes take effect when published. The current version is always at floorstage.com/terms.
19. General
- These terms, the Privacy Policy and the prices shown in the app are the whole agreement between us about FloorStage.
- If a court finds part of these terms unenforceable, the rest still applies.
- You may not transfer your account or this agreement to anyone else. We may transfer it to a successor of our business and will tell you if we do.
- Not enforcing a term today does not waive it tomorrow.
- Notices to you go to your account email; notices to us go through the app (section 20).
